Terms and Conditions for Local Locker

Effective Date: February 5, 2026

These Terms and Conditions (“Terms”) govern your access to and use of the Local Locker mobile application (“App”), operated by Local Locker (“we,” “our,” or “us”). By accessing or using the App, you agree to be bound by these Terms. If you do not agree, you may not use the App.

1. Description of the Service

Local Locker is a peer-to-peer rental platform that allows users to list, rent, and borrow personal items such as sporting goods, camping gear, technology, and musical instruments. Local Locker acts solely as a marketplace and is not a party to rental agreements between users.

2. Eligibility

To use the App, you must:

● Be at least 18 years old
● Provide accurate and complete registration information
● Have the legal capacity to enter into binding agreements

By using the App, you represent and warrant that you meet these requirements.

3. User Accounts

You are responsible for:

● Maintaining the confidentiality of your account credentials
● All activities that occur under your account

You agree to notify us immediately of any unauthorized use or suspected security breach. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Listings and Rentals

a. Item Listings

Users who list items agree that:

● They own or have legal rights to rent the item
● Listings are accurate, complete, and not misleading
● Items are safe, functional, and legal to rent

We reserve the right to remove listings at our discretion.

b. Rentals

Users who rent items agree to:

● Use rented items responsibly and only for their intended purpose
● Return items on time and in the agreed-upon condition

Rental terms, pricing, deposits, and availability are set by the item owner, not Local Locker.

5. Payments and Fees

● Payments are processed through third-party payment providers
● Local Locker may charge service fees, which will be disclosed before completing a transaction
● We do not store full payment card details

Refunds, late fees, damages, or disputes are primarily handled between users unless otherwise stated.

6. Damage, Loss, and Disputes

Local Locker is not responsible for:

● Damage, loss, or theft of items
● Injuries or harm resulting from use of rented items
● Disputes between users

Users agree to resolve disputes directly. We may, but are not obligated to, assist in dispute resolution at our discretion. Any dispute, claim, or controversy arising out of or relating to the use of the app or its services shall be resolved exclusively through binding arbitration, conducted through the app and governed by its terms and limitations. Users waive the right to bring claims in court or to participate in class actions, collective actions, or jury trials, except where such waiver is prohibited by law.

7. Prohibited Conduct

You agree not to:

● Use the App for illegal or fraudulent purposes
● Post false, misleading, or offensive content
● Circumvent fees or platform protections
● Harass, threaten, or harm other users
● Attempt to access systems or data without authorization

Violation of this section may result in immediate account termination.

8. Intellectual Property

All content, branding, logos, and software associated with Local Locker are owned by or licensed to us and are protected by intellectual property laws. You may not copy, modify, distribute, or exploit any part of the App without prior written permission.

By agreeing to the Terms and creating a listing, you grant Local Locker a non-exclusive, worldwide, royalty-free, sublicensable license to use, host, store, reproduce, modify, display, and share photos and other content from your listings in connection with operating, promoting, and improving the app and its services.

9. Termination

Local Locker may, at its sole and absolute discretion, suspend, restrict, or terminate any account, and remove or disable access to any listings, images, or other content, for any reason or no reason, at any time, with or without prior notice.

You may terminate your account at any time through the App or by contacting us.

10. Disclaimer of Warranties

The App is provided on an “as is” and “as available” basis. We make no warranties regarding:

● Availability or uninterrupted operation
● Accuracy of listings
● Conduct or reliability of users

Use of the App is at your own risk.

11. Limitation of Liability

To the fullest extent permitted by law, Local Locker shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the App, including but not limited to loss of property, income, or personal injury. Local Locker is not responsible for providing insurance coverage for any listed items. Users must exercise their own discretion in determining and obtaining any protections or insurance they deem appropriate.

12. Indemnification

You agree to indemnify and hold harmless Local Locker from any claims, damages, losses, or
expenses arising out of:

● Your use of the App
● Your violation of these Terms
● Your interactions or transactions with other users

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the state of Texas, without regard to conflict of law principles.

14. Changes to These Terms

We may update these Terms from time to time. Changes will be posted within the App, and continued use of the App after updates constitutes acceptance of the revised Terms.
